Terms of Sale
These Terms govern purchases from telcosurplus.net (the "Site"), operated by King Network Services Inc. ("we," "us"). By placing an order you agree to them.
1. Products and condition
We sell new, used, and surplus telecommunications and networking equipment. Each listing states the item's condition:
- New — unused; may be new-surplus or open-box, and may not include original packaging or manufacturer warranty unless stated.
- Used — previously deployed or pulled from service. Cosmetic wear is normal.
- Mixed — a lot containing both new and used units.
Photos may be representative of the item rather than the exact unit. Compatibility tags are provided as a guide based on manufacturer information and our experience; you are responsible for confirming that an item, its software/firmware, and any licenses are suitable for your equipment and use.
Software licenses, support contracts, and manufacturer warranties do not transfer with used equipment unless the listing says so. Product names and trademarks belong to their owners; we are not affiliated with or authorized by any manufacturer unless stated.
2. Pricing, quantity pricing, and payment
Prices are in U.S. dollars. Quantity price breaks apply per item to the quantity in a single order. Sales tax and shipping are added at checkout. Payments are processed by Square; we do not store full card numbers. We may correct pricing errors and cancel and refund affected orders.
3. Freight orders
Items that ship by freight (or orders too large or heavy for parcel carriers) are placed without payment. We email you a freight quote and payment link; the order is confirmed when you pay. If you decline the quote, the order is cancelled at no charge.
4. Order acceptance and cancellation
An order confirmation is not acceptance. Surplus stock is limited, and we may cancel an order (with a full refund) if an item is no longer available or for suspected fraud or error. You may cancel before an order ships by contacting us.
5. Shipping and risk of loss
Risk of loss passes to you on delivery to the carrier. Please inspect shipments on arrival and note visible damage with the carrier. See our Shipping Policy.
6. Returns and warranty
See Returns & Warranty. Except as stated there, items are sold AS IS.
7. Export compliance
Some networking equipment is subject to U.S. export controls. You agree not to export or re-export items in violation of U.S. law, or to sanctioned countries or persons.
8. Disclaimer and limitation of liability
EXCEPT AS EXPRESSLY STATED IN OUR WARRANTY POLICY, PRODUCTS ARE PROVIDED WITHOUT WARRANTIES OF ANY KIND, INCLUDING IMPLIED WARRANTIES OF MERCHANTABILITY OR FITNESS FOR A PARTICULAR PURPOSE. OUR TOTAL LIABILITY FOR ANY CLAIM IS LIMITED TO THE AMOUNT YOU PAID FOR THE ITEM GIVING RISE TO THE CLAIM. WE ARE NOT LIABLE FOR INDIRECT, INCIDENTAL, OR CONSEQUENTIAL DAMAGES, INCLUDING NETWORK DOWNTIME OR LOST PROFITS.
9. Governing law
These Terms are governed by the laws of the State of Connecticut, without regard to conflict-of-laws rules. Disputes will be resolved in the state or federal courts located in Connecticut.
